By visiting our website and/or purchasing from us, you agree to be bound by these Terms & Conditions, including any additional terms, policies, and notices referenced here or available on our website.

These Terms & Conditions apply to all users of the site, including without limitation browsers, customers, merchants, and contributors of content.

By accessing or using this website, you confirm that you have read, understood, and agreed to these Terms & Conditions. If you do not agree, you must not use this website or purchase from us.

Products

POKT sells a compact carry case designed to store and organize nicotine pouches. POKT is an accessory only. No nicotine, tobacco, or consumable product is included with any purchase.

Product features and descriptions displayed on the website are provided for general information purposes. POKT is designed to hold up to 9 nicotine pouches and does not include a trash compartment.

POKT is made using a biobased plastic blend.

All product images, descriptions, and specifications are presented as accurately as possible. However, actual product colors may vary slightly due to screen display settings, lighting, and device differences.

Product Use and Care

POKT is intended for the storage and organization of nicotine pouches only.

Customers should not store nicotine pouches inside POKT for more than 24 hours. If the pouches are not being used, they should be returned to their original tin.

POKT is water-resistant but not waterproof. While it offers some resistance to moisture, water may still enter the product. Customers are responsible for using the product appropriately and for protecting the contents stored inside it.

Any misuse of the product, including improper storage, prolonged storage of pouches, exposure to excessive moisture, or use outside its intended purpose, is entirely at the customer’s own risk.

Orders

All orders placed through our website are subject to acceptance and availability.

We reserve the right to refuse, reject, cancel, or limit any order at our sole discretion, including where we suspect fraud, misuse, unauthorized activity, or any breach of these Terms & Conditions.

Once an order is placed, you will receive an order confirmation. This confirmation does not guarantee acceptance of your order. An order is considered accepted only once it has been processed and prepared for fulfillment.

Pricing

All prices on the website are displayed in AED.

At present, prices are not subject to VAT unless otherwise required by applicable law. If VAT or any similar tax becomes applicable, we reserve the right to apply it in accordance with UAE law.

We reserve the right to change pricing at any time without prior notice. Any change will not affect confirmed orders that have already been accepted.

Payment Methods

We accept the payment methods made available on our Shopify store at checkout, which may include:

• Mastercard
• Apple Pay
• Google Pay
• Cash on Delivery, where available through our fulfillment partner

Payment must be successfully authorized and received before dispatch, except for Cash on Delivery orders where payment is collected upon delivery in accordance with the relevant delivery partner’s process.

We reserve the right to refuse or cancel any order where payment cannot be verified, is declined, or is suspected to be fraudulent.

Shipping and Delivery

POKT currently sells and delivers within the UAE.

Our shipping partner is Quiqup.

Delivery options may include:

• Express delivery within 4 hours for eligible orders placed before 5:00 PM
• Standard delivery within 1–2 business days

Delivery availability may vary depending on location, order timing, and operational capacity.

Once a delivery attempt has been made to the address provided by the customer, risk in the order passes to the customer. Customers are responsible for ensuring that the delivery details they provide are accurate and that they or an authorized recipient are available to receive the order.

We are not responsible for failed deliveries caused by incorrect address details, recipient unavailability, refusal to accept delivery, or circumstances outside our control.

Returns, Exchanges, and Refunds

All sales are final unless the product is confirmed to have a defect or unless the customer receives the wrong item.

We do not offer returns for change of mind.

We do not offer exchanges.

We do not accept returns for:

• sale items
• used items
• opened items
• damaged items caused by customer misuse
• items showing normal wear and tear

Shipping fees are non-refundable.

If a product is confirmed to be defective, POKT will cover the return shipping cost.

If an item arrives damaged or incorrect, POKT may, at its discretion, either refund the item or provide a replacement.

Defective Items

A defective item means a product that has clear visible damage upon delivery or a functional error caused by manufacturing.

A defective item does not include:

• normal wear and tear
• cosmetic marks caused after delivery
• misuse
• damage caused by water exposure
• damage caused by improper storage
• damage caused by storing pouches beyond the recommended 24-hour period
• damage caused by handling, dropping, pressure, heat, or any use outside the intended purpose of the product

To report a defective or incorrect item, customers must contact us promptly at support@poktofficial.com or via WhatsApp at +971502743234 with their order details and clear photos of the issue.

No Warranty

POKT products are sold without any express or implied warranty, except where such warranty cannot be excluded under applicable law.

To the fullest extent permitted by law, we do not guarantee uninterrupted use, absolute water protection, or that the product will meet every customer’s personal expectations or preferences.

Intellectual Property

All content on this website, including but not limited to the POKT name, logo, product names, images, graphics, text, design, branding, layout, and website content, is the intellectual property of POKT or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, republish, distribute, modify, upload, display, transmit, scrape, or otherwise use any part of this website or its content without our prior written consent.

Unauthorized use of our product photography, product descriptions, branding, or website content is strictly prohibited.

Website Use

You agree not to use this website:

• for any unlawful purpose
• to commit or encourage fraud
• to interfere with or disrupt the website or its security
• to transmit malicious code, viruses, or harmful software
• to scrape, copy, reproduce, or exploit any part of the website or its content without permission

We reserve the right to suspend or terminate access to the website for any user who breaches these Terms & Conditions.

Promotions, Discount Codes, and Gift Cards

From time to time, we may offer discount codes or promotional offers.

Unless otherwise stated:

• only one discount code may be used per order
• promo codes cannot be combined with other offers
• promo codes may not apply to shipping fees
• promo codes may not apply to bundles or sale items
• promo codes have no cash value and are non-transferable

Gift cards, where offered, are non-refundable and cannot be exchanged for cash unless required by law.

We reserve the right to modify, suspend, or cancel any promotion at any time.

Marketing Communications and Privacy

Customers may choose to opt in to receive marketing communications from POKT by email, SMS, or WhatsApp. Customers may also opt out of these communications at any time.

We may use Shopify tools, Meta Pixel, Google Analytics, and similar technologies to operate, improve, and market our store.

Our collection and use of personal data are governed separately by our Privacy Policy.

Limitation of Liability

To the fullest extent permitted by applicable law, POKT shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of our website, the purchase of our products, or the use or misuse of our products.

This includes, without limitation, any loss of data, loss of business, loss of profits, loss of opportunity, product misuse, content damage, moisture damage, or dissatisfaction arising from the use of the product.

Use of the product is at the customer’s own risk. Customers are responsible for ensuring that the product is used only for its intended purpose and in accordance with the product care instructions provided on our website.

Nothing in these Terms & Conditions excludes liability that cannot be excluded under applicable law.

Force Majeure

We shall not be responsible for any delay or failure to perform any obligation under these Terms & Conditions where the delay or failure results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, war, civil unrest, labor disruptions, transport delays, technical failures, or delivery partner disruption.

Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates and the applicable laws and regulations of the Emirate of Dubai.

Any dispute arising out of or in connection with these Terms & Conditions, the website, or any purchase from POKT shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

Entire Agreement

These Terms & Conditions, together with any policies posted on our website, constitute the entire agreement between you and POKT in relation to your use of the website and purchases made through it.

Changes to These Terms

We reserve the right to update, change, or replace these Terms & Conditions at any time without prior notice.
